About Kesher Talk

  • "Kesher" means "connection" in Hebrew. The banner image is the mosaic floor of a 6th c. synagogue in Jericho, showing a menorah flanked by a shofar and lulav; the inscription reads "Shalom Al Yisrael." (This synagogue was destroyed by Arab vandals a few years ago. The condition of the mosaic floor is unknown.)

The International Court of Justice has ruled on Israel's security fence

The pdf of their ruling can be found here--the meat of their argument starts on page 57.

UPDATES [ from Judith ] :

Dissenting US judge says ICJ did not seriously consider Palestinian attacks. (The US judge was the only dissenter. Quelle surprise. The judge who read out the ruling was from that human rights exemplar China.)

My take on all this is that the ruling is illegitimate, because one of the bedrock concepts of justice is equal treatment before the law. Any court that selectively applies legal rulings is operating from favoritism and special interests. Israel is being treated differently from many other countries which have erected fences to keep out groups which they feel are threats.

I have never studied law, so perhaps the Volokhs can either flesh this out or enlighten me if I got it wrong.

This morning's deadly bombing in Tel Aviv (pictured at right), perpetrated by Yassir Arafat's Fatah Al Aqsa Brigades, was immediately labeled by Prime Minister Sharon as "the first murder under the auspices of the International Court of Justice's ruling."
